Ray & al,
with reference to your email message of June 14th regaring the ICANN board
member election process. (original message attached)

First of all, I would like to explain that the separate
elections@aso.icann.org mailinglist was set up because it would have been
inapropriate for the AC to discuss the election of the future ICANN board
member on the ac-coord list were one of the candidates is present. I also
felt that the audience of ac-coord, which includes not only AC members,
observers/listeners, RIR staff, ICANN staff, and ICANN ASO board members,
were to wide to facilitate open discussion of the candiates.

The list was set up on request by me to include only the AC members + the
observers/listeners, and by implicit consensus by the participants (nobody
suggested otherwise).

With regard to your request to open up this process we would like to point
out that the MOU does not say that the BOD appointment process must be
transparent. The relevant sections of the MOU describe policy proposals, not
selection processes. It would probably be well adviced of us to act in the
spirit of the opennes and transparency to publish the process afterwards to
the whole community, but we have not yet discussed how to do that.

4. In all cases when the Address Council reviews a proposal for new
global policies or a proposed modification to existing policies in this
area it will first solicit the opinions of all of the RIR signatories of
the MOU and of the public.

6.(b) All discussions regarding ASO policy formation will be conducted
on or reported on a publicly-archived mailing list accessible through the
ASO
web site. The schedule for the ASO meetings will be posted 90 days in
advance of the meeting date. The agenda for the Address Council and
General Assembly meetings will be posted on the ASO web site at least 30
days before the meetings. The minutes from all ASO meetings will be
publicly posted on the ASO web site within 30 days of the meeting. In the
unlikely event that the policy formation discussions involve confidential
commercial data that was presented in an address allocation process the
above disclosures must be done in a way to protect the confidentially of
that data.

The BOD selection process is not policy formation, nor is it a proposal
for amending existing policy. It is work that probably would suffer even
more than it did by opening it beyond the participating individuals. We
probably want to work on a policy for future BOD selections. If we work on
the policy in the open meetings, there will be less confusion about why
the selection meetings are less open.

5 of 8 voting members have expressed support for your prosal.
1 have expressed a concern and
2 have not yet been able to participate

Could the ASO Secretariat please add the requested addresses to
elections@aso.icann.org
and invite the relevant persons to take place in the conference call
scheduled

| has removed transparency from the process.  As signatories of the ASO MoU
we
| feel that we have the  obligation to be able to monitor this process so
that
| we can best represent our members who do in fact comprise the ASO.  Under
| the terms of the ASO Mou, the Address Council does not represent members
of
| the ASO but is instead an advisory body to the ICANN.  Accordingly, we
| request that you permit the RIRs to observe the election process by
placing
| the normal RIR observers on the email list and by including those same
| observers on all special meetings convened by the Address Council.
